    FILED APPEAL FOR SC INJURY ROUND 1 BEGINS

    I saw an ankle specialist and he ordered a MRI of my ankle. After reading the MRI and the radiologist report he wrote a letter stating due to the nature of my injury I would definitely need a Fusion surgery. He also stated the injury I have is extremely painful and can cause serious problems with walking. He went further to say that sense there is really nothing holding the ankle in place in would not be uncommon for my ankle to just give way for no apparent reason.

    I sent that in along with the surgical report stating all the bone chips that had to removed from my ankle. The surgeon stated the ligaments tore away from to bone with such force it tore some of the bone away also. That was the bone chips he removed.

    The VA rated me at 10% for a sprained ankle as it is stated in my medical records. But they didn't take into account I was in a remote location where all we had was a medic with no X-Ray machine or other testing equipment.

    So now I wait. I suspect they will turn it down and I'll appeal again.

    A ten percent rating essentially means you take medication (prescription or over-the-counter) for your condition. The VA rater really messed you over. Did you file a Notice of Disagreement (NOD) or move straight to the US. Court of Appeals? A NOD will be quicker and may rule in your favor. This also gives you an additional step in the appeals process. You can also request a rating review to see if they will simply upgrade your disability percentage.


    Did you submit a Disability Benefits Questionnaire (DBQ) with your claim? The DBQs can significantly help your claim serving as a medical diagnosis, condition severity and documentation for the VA to correctly rate your disability. If you haven't submitted a DBQ, do you have a physician, VA or outside, willing to help you? If so, have a physician fill out an "ANKLE CONDITIONS DISABILITY BENEFITS QUESTIONNAIRE?"       I just saw your reply to my post. Thank you for all the information. I actually have someone helping that is knowledgeable to the VA system. I just received a letter from the VA asking what type of appeal I wanted. Please forgive but I can't remember what they called them but I know one was a DOR, that's the acronym of course and that's the one I chose other than the appeal board now that I think about it.

      I didn't know about the questionnaire but I will remember it depending on how things go. I'll keep you posted.
