    Has anyone been able to get disability while refusing to take shots?

    With a MS diagnosis, it's nearly impossible to get approved for a new Individual Disability Insurance policy, or for new individual DI coverage. Individual Disability Insurance applications include questions about any pre-existing diagnosis and access to all medical records, office visits, etc., during the last 5 years.

    If the individual DI policy was issued before your MS dx, there are 'pre-existing' condition limitations in the policy you must be aware of before you file a claim for disability benefits or before you are dx'd disabled for other benefits by your MS doc.

    Group Disability Insurance does not typically include an application for coverage, and does not include medical information.

    Group Disability does include waiting periods for eligibility to participate in the Group DI plan, plus a 1 year exclusion for any disability related claims while premium contributions are paid after the 'eligibility' period is met. (The eligibility waiting period is usually 1 year of continous employment. Once the eligibility and claim waiting periods are met, there is a 2yr look back period.)

    The 2yr look back period allows the insurer to look into your medical history for any claims made during the first 2yrs of coverage.

    When a claim for Group DI benefits if filed during the first 2yr of coverage, the insurance company can decline to pay your claim as pre-existing condition based on any doc you consulted, medical test and/or diagnosis made in the previous 5yrs.

    Any claim for benefits made 2 years and 1 day after the policy effective date typically can not be excluded for payment as a pre-existing condition. The policy may actually state 'after 12:01 AM' on the 2 year policy anniversary date.
    Read your policy for specifics about pre-ex exclusions.

    FMLA, vacation, sick leave, and any other time off to postpone claiming disability may help you develope a stratagy to meet the 2yr exclusion for Group DI benefits.
