    WAITING ON DECISION FOR MY APPEAL

    I filed an appeal for my SC disability back in August. As time went by and I hadn't heard anything I called and the lady told me it is in the decision process and the decision should be made on or before 11/14/15. I can check on it by logging onto ebenefits. So far no decision and it's driving me crazy.

    The VA said I had a sprained ankle. I went to a specialist and had a MRI of my ankle done and the specialist wrote a letter stating I will definitely have to have Fusion surgery in my ankle. He also stated I will never gain full use of my ankle again especially if I don't have the surgery.

    I dotted all my i's and crossed all my t's but the wait is unbearable. But I'll just have to wait.
    Dx'd 4/1/11. First symptoms in 2001. Avonex 4/11, Copaxone 5/12, Tecfidera 4/13 Gilenya 4/14-10/14 Currently on no DMT's, Started Aubagio 9/21/15. Back on Avonex 10/15

    I got my deserved benefits 23.5 years after discharge. I am 100% T&P a few times over, but they still haven't owned everything they should. I'm still deciding whether to appeal a matter or two to the BVA or just try to live life in peace.

    Waiting is horrible because they essentially have part of your future in their hands and they are beyond dysfunctional. I just hope you get a ruling in your favor and don't have to continue to fight them any longer. As always, thank you for your service.

      Thank you for your service too Marco. Yes the do hold part of your life in their hands.

      My case seemed pretty cut and dry to me. I thought the specialist did a wonderful job spelling out my future with the use of the lack thereof about my ankle. He looked at my MRI and looked at me and told me he didn't know how I was even still walking. The pain level on a scale of 1-10 my pain level is a 10. But I take an extremely strong pain killer for the pain in my legs due to my MS. It seemed to me they could look at his report and his prognosis along with the copy of the MRI and it would be a no brainer.

      But this is the Federal Government we are dealing with. Never in a hurry about anything. I'm sure they are trying to find a way out of paying me anymore money. But we shall see. I'll let you know.

        In my case it took 5 years to get my PTSD disability S/C even though the shrink they sent me to clearly stated I had S/C PTSD. I ended up getting 70% for that after the appeal judge through the book at the BVA for all of the stuff they pulled in trying to deny my claim. The rating that I got is still under appeal and who knows how long that will take.

          Yeah Sailors Song I've heard the horror stories. I was fortunate when I first applied for disability it only took about 6 months for approval but for some reason the backdated it about 2 years. They explained why but I never could figure it out. But I didn't complain it just made me more money.

          When I filed this appeal they actually converted to a claim. When I called to check on the status the lady said they did that to expedite the process. That's when she told me I should have an answer on or before 11/14. She gave me a website to go to to track the progress of the claim. All it says is "Prepared for decision." So I guess I'll see.
