ShareOP (Jan 29, 2007 8:10:48 PM)
type your question Chatter 6
Chatter 6 (Jan 29, 2007 8:10:58 PM)
My son is trying desperately to work. He's now down to max of 15 hours a week. Is he hurting himself for when he ultimately applies for SSDI benefits?
Rich Feingold (Jan 29, 2007 8:11:14 PM)
Good question, Chatter 6...
Rich Feingold (Jan 29, 2007 8:11:30 PM)
Of course, each case is different...
Rich Feingold (Jan 29, 2007 8:12:08 PM)
But as a general matter, if one is earning $900/month gross income (for the year 2007), then SSA considers that individual to have engaged in SGA (Substantial Gainful Activity), i.e., work...
Rich Feingold (Jan 29, 2007 8:12:20 PM)
It depends upon how much he is earning and what he is doing...
Rich Feingold (Jan 29, 2007 8:12:41 PM)
Even if one is earning less than that threshold, still, there is some work activity...
Chatter 1 (Jan 29, 2007 8:12:57 PM)
? HOW OFTEN DO YOU FEEL THAT A PERSON HAS A HARD TIME WITH GETTING A DIAGNOSIS? DESPITE THE INTERNIST AND RADIOLIGIST READINT THE MRI.
Rich Feingold (Jan 29, 2007 8:13:04 PM)
which raises the constant issue of what an individual claimant can or cannot do.
Chatter 1 (Jan 29, 2007 8:13:15 PM)
WHERE SHOULD SHE GO?
Rich Feingold (Jan 29, 2007 8:13:16 PM)
Is Chatter 1 next
ShareOP (Jan 29, 2007 8:13:21 PM)
yes
DeanOP (Jan 29, 2007 8:13:50 PM)
But only if you're thru with Chatter 6's question
Rich Feingold (Jan 29, 2007 8:14:28 PM)
I'm pretty much done with Chatter 6's question. Best to talk to an attorney Chatter 6 so that...
Rich Feingold(Jan 29, 2007 8:15:01 PM)
Your son's claim can be looked at as a whole. I can't make a legal judgment here. Now, Chatter 1...

?
Rich Feingold (Jan 29, 2007 8:15:31 PM)
Yes, that issue comes up - having a diagnosis...
Chatter 1 (Jan 29, 2007 8:15:55 PM)
THANKS RICH
Rich Feingold (Jan 29, 2007 8:15:55 PM)
I can't say exactly how often it arises...
Chatter 1 (Jan 29, 2007 8:16:07 PM)
THE DX HAS BEEN SO HARD
Rich Feingold (Jan 29, 2007 8:16:14 PM)
Usually there is something quite wrong whether or not an individual has a diagnosis...
Rich Feingold(Jan 29, 2007 8:16:33 PM)
I went to a conference recently, the NOSSCR Conference...
Rich Feingold (Jan 29, 2007 8:17:09 PM)
and one of the issues that was covered was the need for a diagnosis. If I have further information on this, I'll post it to the message board.
ShareOP (Jan 29, 2007 8:17:21 PM)
DeanOP, you are next on the list.
DeanOP(Jan 29, 2007 8:17:24 PM)
can you earn any money while waiting to see if you get SSDI?
Rich Feingold (Jan 29, 2007 8:17:31 PM)
I meant, this issue of whether a diagnosis is needed. Ok, now Dean.
Rich Feingold (Jan 29, 2007 8:18:11 PM)
Dean...

DeanOP(Jan 29, 2007 8:18:49 PM)
Can you earn anything while...
Rich Feingold (Jan 29, 2007 8:18:52 PM)
One can work while the case is pending, however, once again, one must watch that SGA amount and as I stated above, working may be problematic to a claim...
DeanOP (Jan 29, 2007 8:18:55 PM)
waiting for SSDI?
Rich Feingold (Jan 29, 2007 8:19:33 PM)
I am not telling anyone not to work, it is just that it can be looked at by SSA. Of course, one may have to work to survive...
Rich Feingold (Jan 29, 2007 8:20:33 PM)
There is particular concern about working over the SGA level during the first 12 months of disability as part of the definition of being disabled is having a medically determinable impairment that has lasted or is expected to last at least 12 consecutive months.
ShareOP (Jan 29, 2007 8:20:54 PM)
Chatter 7, you are next on the list.
Rich Feingold (Jan 29, 2007 8:21:24 PM)
ok.
Chatter 7(Jan 29, 2007 8:21:32 PM)
I SWITCHED DR. FEELING MY OTHER ONE WASN'T BEHIND ME. MY NEW ONE SAYS TO APPLY FOR DISIBILITY. I HAVEN'T WORKED SINCE MY DX DUE TO PROBLEMS.......
DeanOP(Jan 29, 2007 8:21:33 PM)
ty Richard
Chatter 7 (Jan 29, 2007 8:22:30 PM)
SHOULD MY NEW DR WHEN FILLING OUT THE FOR I GOT FROM A DISIBILITY SPECIALIST DATE IT BACK TO MY DX DATE?
Rich Feingold (Jan 29, 2007 8:22:58 PM)
OPPS form?
Chatter 7 (Jan 29, 2007 8:23:46 PM)
I GOT A 4 PAGE FORM FOR MY NEW DR TO FILL OUT FROM A DISIBILITY SPECIALIST FROM MY CITY OFFICE
Rich Feingold (Jan 29, 2007 8:23:47 PM)
Oh, you meant to say that you meant "form," not "for." Ok...
Chatter 7 (Jan 29, 2007 8:24:18 PM)
YES
Rich Feingold (Jan 29, 2007 8:24:39 PM)
Ok, well, I guess it is up to the doctor to decide whether he wants to give an opinion as to whether or not you were disabled back to the date of your diagnosis even though he or she was not treating you...

Rich Feingold (Jan 29, 2007 8:26:21 PM)
I believe that Social Security may give more weight to your current doctor's opinion in regard to his or her personal observations and tests while treating you, what he or she has observed in treating you presently.
DeanOP(Jan 29, 2007 8:26:35 PM)
?
Rich Feingold (Jan 29, 2007 8:26:40 PM)
I'm done with my answer.
ShareOP(Jan 29, 2007 8:26:47 PM)
Go ahead Dean
DeanOP (Jan 29, 2007 8:26:53 PM
Do your personal assets count with SSDI?
Rich Feingold (Jan 29, 2007 8:27:12 PM)
SSDI stands for Social Security Disability Insurance benefits...
Rich Feingold (Jan 29, 2007 8:27:57 PM)
These are benefits based upon how much one has earned while working. Assets and passive income do not prevent an individual found by SSA to be disabled from receiving SSDI benefits...
Rich Feingold(Jan 29, 2007 8:28:28 PM)
This contrasts with SSI (Supplemental Security Income) disability benefits where income and assets may prevent one from receiving benefits.
Chatter 1 (Jan 29, 2007 8:28:43 PM)
RICH I HAVE SHORT TERM DISABILITY AND LONG TERM DISABILITY- IS THERE A MISTAKE THAT I COULD MAKE THAT I SHOUD NOT?
Rich Feingold (Jan 29, 2007 8:29:06 PM)
I'm not sure what you mean specifically, Chatter 1.
Chatter (Jan 29, 2007 8:29:07 PM)
I AM NEWLY DIAGBNOSED OF COURSE
Chatter 1 (Jan 29, 2007 8:29:31 PM)
WELL I HAVE SHORT TERM WHICH MEANS 8 DAYS OUT OF SERVICE
Chatter 1 (Jan 29, 2007 8:29:52 PM)
AND I WILL THEN HAVE TO G0 WITH LONG TERM
Chatter 1 (Jan 29, 2007 8:30:02 PM)
AND THEN ONTO DDSI
Chatter 1 (Jan 29, 2007 8:30:13 PM)
I KNOW NOTHIGN ABOUT IT ALL
Rich Feingold (Jan 29, 2007 8:30:46 PM)
So, you are receiving short term benefits and you think that you may have to go onto long term disability benefits and then on to SSDI benefits is what I understand.
Rich Feingold (Jan 29, 2007 8:30:50 PM)
So...
Chatter 1 (Jan 29, 2007 8:31:13 PM)
NO, I HAVE NOT TRIED SHORT TERM YET
Chatter 1(Jan 29, 2007 8:31:19 PM)
I SO WANT TO WORK
Chatter 1 (Jan 29, 2007 8:31:29 PM)
BUT I HAVE TO HAVE INCOME
Chatter 1 (Jan 29, 2007 8:31:33 PM)
I AM ALONE\
Rich Feingold (Jan 29, 2007 8:31:39 PM)
Right, I understand. Ok, well, in general, one can received LTD and still apply for Social Security disability benefits
RagdollOP (Jan 29, 2007 8:32:17 PM)
?
Rich Feingold (Jan 29, 2007 8:32:20 PM)
Of course, what one must prove in order to obtain LTD vs. SSDI benefits may vary...
Chatter 1 (Jan 29, 2007 8:32:20 PM)
IS THERE A SPECIAL "CARD" TO HELP US GET LTD BENEFITS FROMSS
Rich Feingold (Jan 29, 2007 8:33:03 PM)
In general, I encourage people to work as long as they can, of course, because trying to get these benefits can sometimes be difficult and time consuming.
Rich Feingold (Jan 29, 2007 8:33:14 PM)
One doesn't get LTD benefits from SSA.
Chatter 1 (Jan 29, 2007 8:33:15 PM)
OK THANKS
ShareOP< (Jan 29, 2007 8:33:24 PM)
Go ahead Ragdoll.
Rich Feingold (Jan 29, 2007 8:33:32 PM)
LTD benefits are from an insurance carrier. Thanks.
Rich Feingold (Jan 29, 2007 8:33:47 PM)
Ok, Ragdoll?
RagdollOP (Jan 29, 2007 8:33:50 PM)
when a person on SSDI reaches normal retirement age do they switch from SSDI to regular SS?
RagdollOP (Jan 29, 2007 8:33:56 PM)
ty in advance
DeanOP (Jan 29, 2007 8:34:17 PM)
?
LizOP (Jan 29, 2007 8:34:29 PM)
Because of the number of people here, we are using Protocol. If you want to ask a question, please type ? and enter it on the screen. If you want to make a comment, type ! and enter it on the screen. You will be called in order. Thank you for your cooperation.
Rich Feingold (Jan 29, 2007 8:34:41 PM)
Right; they receive the same benefit amount (still getting yearly cost of living increases), but it is paid from a different fund.
RagdollOP (Jan 29, 2007 8:35:02 PM)
so it becomes taxable then, correct?
Rich FeingoldJan 29, 2007 8:35:47 PM)
Taxes are a different story. That you will need to discuss with your tax advisor. Check out SSA's web site for some general information, too - www.ssa.gov
RagdollOP (Jan 29, 2007 8:35:55 PM)
ty for answering my question
Rich Feingold (Jan 29, 2007 8:36:00 PM)
Sure; thanks for asking.
ShareOP (Jan 29, 2007 8:36:06 PM)
You are next Dean.
DeanOP (Jan 29, 2007 8:36:07 PM)
Ballpark, what does it cost to have a lawyer help you with your application?
RagdollOP (Jan 29, 2007 8:36:07 PM)
yw
Rich Feingold (Jan 29, 2007 8:36:45 PM)
When you say ballpark, I presume you mean what is the average fee that a claimant pays to have representation?
DeanOP (Jan 29, 2007 8:36:51 PM)
yep
Rich Feingold (Jan 29, 2007 8:37:54 PM)
I'd say about $3,000 might be an average. Makes sense given that $5,300 is the maximum fee when an attorney uses the fee agreement process in most cases because $5,300 divided by 2 = $2,650.
Rich Feingold (Jan 29, 2007 8:38:10 PM)
Of course...
Rich Feingold (Jan 29, 2007 8:38:16 PM)
it is a contingent fee...
Rich Feingold (Jan 29, 2007 8:38:32 PM)
meaning that the attorney gets paid only if the claim is paid.
DeanOPJan 29, 2007 8:38:44 PM)
is it better to start with representation or wait till you're turned down once?
Chatter 7 (Jan 29, 2007 8:38:56 PM)
?
Rich Feingold (Jan 29, 2007 8:39:04 PM)
I think that it is better to start with representation, DeanOP, because...
Rich Feingold (Jan 29, 2007 8:39:31 PM)
I've seen some claimants make mistakes which may be detrimental to their claims.
Rich Feingold (Jan 29, 2007 8:39:43 PM)
And an attorney can help...
Rich Feingold (Jan 29, 2007 8:40:20 PM)
during this often frustrating and time consuming process to stay on top of the bureaucracy.
ShareOP (Jan 29, 2007 8:40:36 PM)
You are next Chatter 7.
DeanOP (Jan 29, 2007 8:40:38 PM)
thank you! great info!
Rich Feingold (Jan 29, 2007 8:40:49 PM)
Thanks, Dean.
Chatter 7(Jan 29, 2007 8:41:04 PM)
I'm waiting for a hearing which can take up to 2 yrs. the disability specialist at our co. office wants to try and get a special hearing instead of waiting. is this a good thing to do?...
Chatter 7(Jan 29, 2007 8:41:34 PM)
will it hurt me if I get denied at this special hearing she wants me to have?
Rich Feingold (Jan 29, 2007 8:41:41 PM)
So you are waiting for a Social Security disability hearing before an administrative law judge...
Rich Feingold (Jan 29, 2007 8:41:55 PM)
and you are being represented by a "disability specialist?
Chatter 7 (Jan 29, 2007 8:42:03 PM)
yes
Rich Feingold (Jan 29, 2007 8:42:40 PM)
I'm not sure what is meant by "special hearing." Maybe he or she is trying to obtain an expedited hearing, i.e., trying to push the matter so you don't have to wait so long.
DeanOP(Jan 29, 2007 8:42:51 PM)
?
Chatter 7 (Jan 29, 2007 8:43:10 PM)
yes I think that is what she wants to do
Rich Feingold (Jan 29, 2007 8:43:32 PM)
Ok, well good luck to you; I hope you don't have to wait so long!
ShareOP (Jan 29, 2007 8:43:41 PM)
Does that answer your question Chatter 7?
Chatter 4Jan 29, 2007 8:43:54 PM)
?
ShareOP(Jan 29, 2007 8:43:58 PM)
Go ahead Dean.
Chatter 7 (Jan 29, 2007 8:44:06 PM)
Will doing this make me look bad to the courts?
DeanOP (Jan 29, 2007 8:44:07 PM)
Is it harder to get SSDI the closer you are to retirement? I'm 56 and will be eligible in March of 2008
Rich Feingold (Jan 29, 2007 8:44:53 PM)
You mean to the Administrative Law Judge? I suppose it depends upon what reason is giving to try to obtain a sooner hearing. I think that a lot of people are waiting a long time...
Rich Feingold (Jan 29, 2007 8:45:34 PM)
e.g., here in the Chicago area, some files are being transferred to one of the hearing offices from another state where I heard that the delay is over 2 years...
Rich Feingold (Jan 29, 2007 8:46:02 PM)
I hope that SSA understands that people are trying to have their claims decided as promptly as possible.
Chatter 7 (Jan 29, 2007 8:46:34 PM)
ok thank you
Rich Feingold (Jan 29, 2007 8:46:40 PM)

DeanOP (Jan 29, 2007 8:47:00 PM)
is it harder to get SSDI the closer you are to retirement?
Rich Feingold (Jan 29, 2007 8:47:18 PM)
Eligible for what in 3/08 Dean?
DeanOP (Jan 29, 2007 8:47:23 PM
SSDI
Rich Feingold (Jan 29, 2007 8:47:33 PM)
Why then? Did you mean Medicare?
DeanOP (Jan 29, 2007 8:47:51 PM)
No I wondered if the SSDI folks...
DeanOP (Jan 29, 2007 8:48:12 PM)
might figure I'm so closer to 65, and it can take 2 years...
DeanOP(Jan 29, 2007 8:48:24 PM)
I could BE 65 before my claim is decided
Rich Feingold (Jan 29, 2007 8:49:18 PM)
If you are 56, you’re full retirement age is above 65, I believe, but it would be...
Rich Feingold (Jan 29, 2007 8:50:23 PM)
rare indeed for a claim to take 9 years. Age can be a helpful factor in some claims, especially age 55, in some claims.
DeanOP (Jan 29, 2007 8:50:27 PM)
So there's no age bias in deciding claims?
Rich Feingold (Jan 29, 2007 8:50:43 PM)
Age 55 and older, I meant.
DeanOP (Jan 29, 2007 8:51:21 PM)
Thank you Richard...that's a relief.
Rich Feingold (Jan 29, 2007 8:51:27 PM)
In some claims, being age 50 or older can make a difference between winning and losing. Another, sometimes, more beneficial...
Rich Feingold (Jan 29, 2007 8:51:55 PM
age category is age 55 - 60 and above...
Rich Feingold(Jan 29, 2007 8:52:43 PM)
In some cases, if one is age 50 or above, even if one can perform some work, they can still be found to be disabled. This is where SSA's "Medical-Vocational Guidelines" (or "Grids") come into play...
Rich Feingold (Jan 29, 2007 8:54:06 PM)
I had a hearing last week with a 60 year old former fireman who was found disabled even though the medical expert doctor at the hearing testified (and the ALJ accepted) that he could perform work at the "light" exertional level...
Rich Feingold (Jan 29, 2007 8:54:34 PM)
Ok, next, please.
Chatter 1: How do I activate the grids?
Rich Feingold(Jan 29, 2007 8:56:09 PM)
One last comment re: the fireman...it was the Grids that was used as a framework for decision making that allowed the ALJ to find the claimant disabled.
DeanOP (Jan 29, 2007 8:56:10 PM)

By they want, this is one reason why it is a good idea to have representation, unless one knows the regulations that apply, one would not know to raise this argument.
Rich Feingold (Jan 29, 2007 8:58:12 PM)
In fact, the case turned on the interpretation of four words, "significant range of work."
Chatter 8 (Jan 29, 2007 8:58:31 PM)
THANK YOU. I AM FROM MAINE NEWLY DIAG. IN NOV. I HAVE BEEN ON PARTIAL DISABILITY SINCE NOV. AND GOING ON FULL TIME FEB.1 FOR A COUPLE OF MONTHS TO REEVALUATE. WOULD THIS COUNT TOWARDS WAITING PERIOD?
