Exclamation Backpay?

Hi Mr. Feingold,
I went to SSA today and inquired what my benefit amount would be if im approved I am currently awaiting a ALJ hearing. The lady told me I would be entitled to 633.00 from SSDI and 85.00 from SSI. I asked her if my 6 year old son would be entitled to any benefits on my behalf she said no but then I called SSA when i got home and she told me yes. I have a few questions.
1) If approved do i get backpay even though i would be recieving both SSI and SSDI?
2) Will my son get any benefits extra than my benefit?
3) Since I am recieving State assistance right now, does the lawyer automatically send them what i would owe from getting assistance or do they automatically take it out?

Donna - thank you for your post and I just want to remind everyone that the best person to answer specific questions regarding one's claim is one's attorney as they have worked on your claim.

As a general matter, whether or not one is entitled to "back pay" depends upon one's application date and determined onset date. With low DIB benefit amounts, there may be no DIB benefits available for auxiliary beneficiaries, such as children. My understanding is that SSA will reimburse the state for state assistance out of the past due SSI benefits before the claimant is paid.
